Oklahoma security deposit law
Short answer: An Oklahoma landlord has 45 days after the tenancy ends, the tenant moves out and the tenant asks in writing to return the deposit balance with an itemized statement. A tenant who doesn't ask in writing within six months loses the deposit. State law sets no limit on the deposit amount.
| Deadline to return the deposit | 45 days after the tenancy ends, the tenant hands over possession, and the tenant makes a written demand. |
|---|---|
| Limit on how much a landlord can charge | No limit in state law. |
| Itemized list of deductions | Yes. Unpaid rent and damages must be itemized in a written statement, mailed return-receipt-requested or handed to the tenant. |
| Interest on the deposit | Not required. The balance is returned without interest. The deposit must be kept in an escrow account at a federally insured bank in Oklahoma. |
| Penalty if the landlord breaks the rules | A tenant can recover the deposit and any prepaid rent if the landlord doesn't comply. Misappropriating a deposit from the escrow account is a crime, punishable by up to six months in county jail and a fine of up to twice the amount taken. |
| What the tenant has to do | Ask for your deposit back in writing. If you don't within six months after the tenancy ends, the deposit goes to the landlord. Don't use the deposit as your last month's rent unless the lease allows it. |
